Volkswagen Fraudulent Emissions Testing Class Action

On September 23, 2015, Edwards Kirby filed a class action complaint alleging fraudulent conduct against automaker Volkswagen, on behalf of plaintiffs in North Carolina. The suit was filed in U.S. District Court.

The complaint alleges that Volkswagen used special software to cheat emissions tests on certain vehicles. According to the complaint, the “clean diesel” vehicles in question emitted up to 40 times the legal limit of nitrogen oxides (NOx), a toxic emission that can cause a variety of health problems, while running normally. Once an emission test was initiated, however, the software detected this and turned on full emissions control. Emissions were controlled only during the test, meaning these vehicles were emitting illegal levels of NOx during normal operation.

The case has been filed on behalf of all current and former owners of the following Volkswagen vehicles:

  • VW Jetta (2009-2015)
  • VW Beetle (2009-2015)
  • VW Golf (2009-2015)
  • VW Passat (2014 & 2015)
  • Audi A3 (2009-2015)

Donald Kevin Vinson of Highland, North Carolina is the lead plaintiff in the suit. Edwards Kirby has partnered with Blasingame, Burch, Garrard & Ashley, an Athens, Georgia law firm, to handle this case.
